I am the administrator of the estate of represented as the " Seller '' of the property in question, in XXXX XXXX TX. The lender for the buyer has now delayed closing for the XXXX time in order to prepare paperwork. As title signing requires a physical presence for signature. I have now used XXXX vacation days from my job to sign per contractual closing requirements. The day off, now for the XXXX time, the lender has delayed last minute, citing yet again for the XXXX time to get the paperwork in order. I work for a financial institution and have never seen delays like this before. I have wasted vacation days that I can not get back. This has been the most frustrating real estate transaction that I have ever experienced. The # XXXX amendment changing the closing date has been attached.
I have made multiple requests to cancel the PMI on my loan. I initially requested they cancel the PMI on my loan two years ago when my loan first reached 80 % XXXX and the refused to remove the PMI. They stated that they calculated XXXX based on the original purchase price. Their website indicates otherwise. And they are not required by law to do so, they can use the original appraised value which was higher than the purchase price. As of this month my XXXX is 78.7 % based on the original purchase price and they have failed to respond to my requests to remove the PMI. I have emailed multiple times, I have called and was promised a call back which did not happen and I submitted a request online.
We incurred an escrow shortage for tax year XXXX. Our mortgage increased {$1500.00} XX/XX/XXXX. This increase was without any advanced notice or thorough explanation. They just went ahead and increased the amount of the auto-payment. In XXXX ( don't have specific dates ) it looks 3 separate phone calls to speak with reps just to understand the numbers behind the shortage. It genuinely feels like their CSR 's are intentionally not trained so they can not be helpful. We were then able to increase the escrow repayment from 12 months to 36 months, which brought the monthly payment down {$770.00} per month. It feels like this is a conversation that needs to be had before they just start snatching more money without notice. Had a change in insurance XXXX months ago, I have called them ( Cross Country Mortgage ) XXXX times and left a message with their front desk. They did cancel my previous insurance now they are changing me for the insurance part of the escrow when I have no insurance registered. My new insurance provider can not get ahold of them aswell and they want to cancel my policy. The mortgage was previously serviced by Rocket Mortgage now it is serviced by Cross Country Mortgage.

On cross-country mortgage website you are able to make a payment towards monthly dues, make additional payment and/or make payment to escrow. Every month I go on and make 2 different payment. Half mortgage on first paycheck and rest of mortgage on last pay check. First payment goes into " unapplied '' funds but deducts from my monthly dues. However, when i go to make last payment for the month their system automatically applies it to " additional principal '' even though I did NOT select additional principal payment but MAKE A PAYMENT towards my remaining monthly payment. I was told that I'll just have to keep calling every month to have them move the payment to the correct location instead of their system applying the payments as I am submitting them accordingly. I requested a standard payoff statement for my loan from CrossCountry Mortgage, LLC. The company requires a {$25.00} expedited fee to provide the payoff statement via email or fax, regardless of whether expedited delivery is actually needed. The only free option offered is delivery by mail, which takes approximately 46 business days. I was not given the option to receive the payoff statement electronically without paying the fee, even if I was willing to wait. This practice effectively forces customers to pay for timely access to their own loan information and limits reasonable access to standard account documents.

On XX/XX/XXXX I got a denial stating that I could not cancel my escrow due to owing greater than 80 % on the loan but I never asked to cancel my escrow just the flood insurance. I am submitting a complaint regarding CrossCountry Mortgages failure to disburse my property taxes from my escrow account following a servicing transfer, resulting in delinquent taxes and penalties. The reason I didn't continue with this complaint is Cross Country Mortgage had finally presented us with an acceptable loan modification agreement which we agreed to after the foreclosure.
