This company also recently may have changed their companies name to XXXX XXXX Each billing cycle, a " Statement Balance Fee '' is charged based on my Cash Advance Balance, in addition to my minimum payment. As a result, the majority of each biweekly payment goes toward this recurring fee rather than reducing my principal balance, and my account balance has not meaningfully decreased despite consistent payments. I believe this fee structure functions similarly to an extremely high effective interest rate that would be not permitted under my state 's usury laws if not for the bank 's out-of-state charter arrangement.

I am submitting this complaint regarding my XXXX line of credit account. On or about XX/XX/year>, I disputed the accuracy of the information XXXX was reporting to the credit bureaus. The debt collector, XXXX XXXX XXXX, is violating the FDCPA by disclosing my private financial and debt information to a third party. They have sent multiple text messages to my sister-in-law 's personal cell phone regarding an alleged CASHNET USA account. The text messages explicitly address me by name, disclose that a debt is overdue, and explicitly mention specific dollar amounts ( such as a balance and settlement offers ) This third party is not a co-signer, spouse, or legal representative on the account. These unauthorized third-party disclosures have occurred multiple times ( including on Thursdays and Mondays ), causing significant distress and violating my federal consumer rights. In late XXXX of this current year I was approved for a {$1500.00} loan from CashNetUSA online but prior to that I spoke to their representatives and was totally missed and lied to about the interest on this loan that was OVER 100 % interest over less than 1 year of monthly payments. In fact the total amount that was to be paid back was in EXCESS of {$3500.00} on a {$1500.00} installment loan. On or about XX/XX/XXXX, I obtained an installment loan originated by XXXX Bank XXXX XXXX XXXX and serviced by NetCredit ( Loan ID ending in XXXX ). The contract expressly states that ACH/EFT authorization was optional and not required to obtain the loan. ACH payments were processed through early XX/XX/XXXX. On XX/XX/XXXX, an ACH debit was rejected by my bank with the reason Customer account is closed. Since that date, I have repeatedly disputed the servicing, requested proof of valid authorization for all ACH attempts, full ACH trace records, itemized balance explanation, and corrected amortization schedule. NetCredit has refused to provide the required authorization records or proof that they had the right to initiate debits from my account. I am filing this complaint regarding my NetCredit line of credit because I have made multiple attempts to repay my debt, but I have been denied a reasonable opportunity to do so. I had a loan account that ended up going to collections during XXXX in XXXX I worked with the collection agency to get them to honor the original payoff after and have since paid it off in XXXX. The loan company however states they have no intention to close the acccount or mark it as paid or anything ever. XXXX were there exact words. My complaint concerns the recurring " XXXX XXXX XXXX '' charged on this account. I was never given a clear annual percentage rate. The cost of this credit is built almost entirely from a " XXXX XXXX XXXX '' charged at the end of every billing cycle. I have been contacted by XXXX collectors for a NetCredit bill of {$1000.00}. I completed a mortgage refinance XXXX years ago and contacted NetCredit to find out what was owed so I could pay it off. I was given a {$2100.00} debt which the company I worked with sent me a check to send to them for the debt and have it paid off. A couple months after I was alerted that I still owed them {$1000.00} which is all interest. This would have been taken care of when I first paid it off but no one gave me a {$1000.00} interest debt. That amount stayed the same for almost XXXX years when it was sent to a collection company. I have already paid what they told me I owed to pay it off and {$1000.00} added as interest is over the top. I would like to get some help to put a stop to the harassment for this. I feel that I am being asked to pay a different amount then what was originally owed
My wife was contacted several times by phone concerning an outstanding account with CashNetUSA. She did not accept the calls but was suspicious when we received a bill from the company. We contacted the company to report the identity theft. My information was correct, but another email was used. The company demanded a police report and took no actions to close the account immediately. I have since provided the police report and demanded they close the account and reverse any actions taken against my credit report. This has been an extreme inconvenience as I have had to take time off from work to create the paperwork after they allowed this account to be opened without my consent.

This debt collector has done unjustifiable practices of the FDCPA which it prohibits. They furnished this account that we didn't agree upon and I didn't sign an agreement on. A legal contract is signed by two parties and I did not participate in any of it. They didn't follow the proper 5-step validation procedure. According to the FDCPA, I'm entitled to compensation for these violations and clearly, they violated my rights and abused my privileges. This situation has caused me significant stress and anxiety, affecting my mental health and overall well-being.
