I am the original and primary borrower on this auto loan. I recently discovered that the company processed 13 payment extensions on my account. I did not request, approve, sign, or authorize any of these extensions. I was not informed that these repeated extensions were being added to the loan or how they would affect the interest, principal balance, maturity date, or my credit. The loan was opened in XXXX XXXX for approximately {$28000.00} at an APR of 26.4 %, with a monthly payment of {$800.00}. The account currently shows approximately 48 payments made, 13 months extended, a maturity date of XXXX XXXX, and a remaining balance of approximately {$25000.00}. Despite years of payments, very little principal appears to have been reduced. The vehicle has been used by my XXXX father, but the loan is legally in my name. I never authorized him or anyone else to modify the contract, request payment extensions, or make servicing decisions on my behalf.

The dealer refused to approve me with " no money down '' and also rejected a {$1000.00} down payment. This was presented not as an option but as a non-negotiable requirement from the lender, Exeter Finance. This constitutes a deceptive and unfair practice under the Missouri Merchandising Practices Act, as it was a material misrepresentation designed to extract the maximum possible cash from me at origination.

EXETER FINANCE LLC is reporting a vehicle-finance account in my name as a charge-off. I dispute the accuracy and completeness of this account and request that the charge-off and related account information be deleted unless Exeter can fully verify the obligation through reliable evidence. Exeter Finance LLC 's continued reporting of this account as a charge-off has caused substantial and ongoing financial harm. Because of this reporting, I have been denied credit, my credit score has declined, and my ability to obtain financing and secure housing has been negatively affected. The inaccurate reporting has made it difficult for me to move because landlords and lenders review my credit history when evaluating rental and financing applications. This disputed account has damaged my financial reputation and continues to interfere with my ability to obtain affordable credit, housing, and other financial opportunities.

Dealing with EXETER FINANCE, They came and repossessed my vehicle. They gave me an extra month to pay, but still came to take my vehicle. They basically closed my account, and on my credit it's stating I owe {$19000.00}. On the website, it says I owe {$5600.00}. On their bank statement on their website, it says I owe {$13000.00}. I am disputing an alleged auto loan deficiency balance being collected by Exeter Finance LLC. I demand a complete administrative zero-out and deletion of this alleged debt due to extensive statutory record violations under the Pennsylvania Motor Vehicle Sales Finance Act ( MVSFA ), failure to credit unearned product premiums, and major unresolvable accounting contradictions.First, the company 's internal transaction and ledger calculations are profoundly defective. My official customer portal dashboard from XX/XX/XXXX explicitly tracked my remaining principal balance at {$9800.00}. However, in their subsequent XX/XX/XXXX Notice of Repossession, the company inflated my contract baseline balance to {$15000.00} without any itemized justification. We purchase this vehicle XXXX years ago. We have paid but had some hardship during the loan. I lost a job, gained another job my wife had covid which put us in catchup mode. I financed a XXXX XXXX XXXX through Exeter Finance on XX/XX/XXXX in the original amount of {$35000.00}. I also made a {$5000.00} down payment. Between the down payment and the 89-month, $ XXXX schedule reflected in Exeter 's own credit reporting, the total cost of this vehicle would have been {$76000.00} more than double what I financed before the deficiency Exeter now demands. During the loan, my mother passed away and I paid for her funeral out of pocket, which caused me to fall significantly behind. Exeter knew I was in hardship that is why I was in their deferral programs and rather than provide genuine assistance, they used my circumstances to extract maximum interest. Exeter repeatedly deferred my missed payments to the " back end '' of the loan, telling me the deferred balance would accrue interest at up to approximately {$17.00} per day. As a borrower in hardship, I had no realistic alternative but to accept their terms or lose the vehicle I needed.

I am submitting a complaint regarding severe and ongoing harassment by a debt collector, Exeter Finance. I do not have a business relationship with this company, nor do I owe them a debt. They are repeatedly calling my personal phone number attempting to reach someone else. To date, Exeter Finance has called my number more than 30 times. On 5 separate occasions, I have answered the call, explicitly informed their representatives that they are calling the wrong number, and demanded that my number be removed from their system. Despite my repeated verbal notifications that they have the wrong person and my clear requests to stop calling, the calls have not ceased. This relentless volume of calls to a wrong number, after being repeatedly notified of the error, constitutes abusive and harassing debt collection practices under the Fair Debt Collection Practices Act ( FDCPA ).

XXXX XXXX XXXX is attempting to collect a fundamentally inaccurate debt amount, and their assigned legal counsel, XXXX XXXX XXXX, is threatening legal action based on flawed data. This alleged debt originates from an Exeter Finance auto loan. I initiated a voluntary repossession with Exeter, but the vehicle was never retrieved by Exeter or any third-party towing company. The vehicle remains entirely in my physical possession today. Because the vehicle was never repossessed, it was never sold at an auction. Therefore, no legal " deficiency balance '' can exist. Exeter Finance improperly charged off the entire remaining loan balance as a total loss and sold this inaccurate paperwork to XXXX XXXX XXXX. I have verbally notified XXXX XXXX XXXX and XXXX XXXX XXXX that the asset was never recovered and that the balance they are demanding is false.
