I am a Massachusetts consumer seeking assistance regarding an active small claims court lawsuit ( Case XXXX XXXXXXXX ) resulting from operational delays by Freedom Debt Relief. I enrolled in XX/XX/XXXX and have perfectly maintained all required program deposits. In XX/XX/XXXX, I approved a program deposit increase to ensure my credit card accounts had sufficient settlement funding. However, the company 's backend system delayed implementing this increased funding for 14 months. This delay left my credit card accounts without the necessary settlement cash, which directly led to XXXX XXXXXXXX XXXX filing a lawsuit against me. Additionally, Freedom 's assigned defense law firm, XXXX XXXX, has not provided an update or response for over a month despite the upcoming trial date.

IMPORTANT NOTICE : " Nothing in this complaint should be construed as a waiver of my right to pursue all available legal remedies, including actual damages, consequential damages, attorney 's fees, and any other relief permitted by applicable federal or state law. '' When I enrolled in Freedom Debt Relief, I provided a complete spreadsheet identifying every debt I wanted included in the program, along with copies of all corresponding account statements. Despite providing complete documentation at the outset, I have repeatedly had to contact Freedom Debt Relief to review and verify which accounts were supposed to be included in my debt relief program. Throughout my enrollment, Freedom Debt Relief has demonstrated a pattern of mismanaging my accounts. In XX/XX/XXXX, it was discovered that Freedom Debt Relief had been making payments on an account that was never authorized for enrollment. The account did not belong to me and was approximately XXXX to XXXX XXXX XXXX.

Filing complaint against Freedom Debt Relief. 10 months into the program I am being sued by a creditor. Was lied to and given misleading and false information when I signed up for the program. After being served papers I am know being told I gave to appear court and follow instructions per the court. I was promised when I signed up that their law firm named XXXX XXXX represents all of those who are enrolled in the program. This is not the case. XXXX law hung up on me. I have 20 days to respond. I have paid freedom debt relief thousands of dollars and I have zero help or protection. I have to seek legal representation on my own which is what I was told was already included as a part of my plan and fees to the relief program. I should have checked. They have already been sued for doing the exact same thing to others. They continuing to still do it years later.

I made the mistake of working with Freedom Debt Relief. My payments due got more expensive than I was told originally and due to their lack of response the last 3 debts were able to sue me. I spoke to all 3 Before this happened and was told they gladly work with Freedom Debt but they had not be reached out to and I was unable to fix anything because I was working with Freedom Debt Relief. I had no choice but to apply for the " Acheive Loan '' through Freedom Debt Relief because their lack of action on the last 3 debts caused XXXX on my home that I did not know about until I was selling it. I called on XX/XX/XXXX to ask about a lower payoff amount and was told they would not accept any lesser amount. This company engaged in unethical credi practices and engage in predatory credit structures that trap people in high-interest debt cycles.

I hired Freedom Debt Relief for debt settlement. I just checked my credit report and many of my debts have been charged off and put into collections. I did not know this, nobody notified me, as all communication was supposed to be done between the debtors and FDR. They are charging me fees to do nothing except pay one debt that I was already paying. None of this makes any sense. I sent them a letter stating : I am formally canceling my participation in your debt relief program effective immediately. I revoke any authorization for ACH withdrawals or electronic debits from my bank account pursuant to the Electronic Fund Transfer Act. You no longer have authorization to withdraw funds from my account. I request written confirmation that : 1. My account has been closed 2. Future withdrawals have been canceled 3.

Achieve also allows customers to manage payments online, so they are required to provide an online method to stop recurring charges. This debt collector has engaged in conduct that violates the Fair Debt Collection Practices Act ( FDCPA ). They are reporting an account that I did not authorize, and no signed agreement exists bearing my signature to validate any obligation. A legally binding contract requires clear consent from all parties, which is absent in this case. Additionally, the collector has failed to provide proper validation of the alleged debt as required under the FDCPA. Without sufficient documentation verifying the debts legitimacy, their continued reporting and collection efforts are unlawful. These actions constitute violations of my consumer rights. As a result, I demand the immediate deletion of this account from all reporting agencies. Failure to comply may result in further legal action, including claims for damages.

I enrolled in Freedom Debt Relief after discussions with their representatives regarding resolving my debt and the expected impact on my credit. During the enrollment process, I was led to believe that once accounts were resolved through the program, the negative accounts would ultimately be removed from my credit report or that the program included efforts to improve/remove the associated derogatory reporting. Based on these representations, I agreed to enroll and stopped making payments to my creditors as instructed by the company. After entering the program and authorizing settlements, I later received written clarification from Freedom Debt Relief stating that : * they only negotiate reduced balances, * they are not credit repair experts, and * they can not confirm removal or updating of negative credit reporting. This materially differs from what I understood during enrollment and what I relied upon in deciding to participate in the program.

Complaint : I am submitting this complaint against Freedom Debt Relief for making material misrepresentations regarding the services they would provide, charging fees prior to achieving settlements, and failing to perform as promised. At the time I enrolled in their program, Freedom Debt Relief represented that they would negotiate with my creditors to settle my debts and that they would assist in the event collection actions were filed against me, including having counsel appear or otherwise provide meaningful legal support. These representations were a significant factor in my decision to retain their services. However, after enrolling in the program and making payments, Freedom Debt Relief has failed to fulfill these promises. Specifically : They have not effectively negotiated settlements with my creditors as represented. Creditors have continued collection efforts, including the filing or threat of lawsuits.
