I was notified by my mortgage company of a lien on my property placed by this company. I requested a payoff letter of the debt via phone on XX/XX/XXXX the number i spoke with a rep on was XXXX. On XX/XX/XXXX I phoned the office again the agent provided me the email address XXXX and verbiage to use to request the payoff letter I sent the email and received a response that my request was received and the letter would be received in 1-2 business days. I phoned XXXX on XX/XX/XXXX and spoke with a rep they advised they received the request and to send another email to XXXX. Rebuttal to Response CFPB Complaint # XXXX I dispute the claims made by Lloyd & McDaniel , PLC as inaccurate and misleading. Their response states that the phone number used to contact me was provided by the original creditor, XXXXXXXX XXXX XXXX XXXXXXXX. This is not possible. The number that was called is a work phone number associated with my current employment. I did not begin working at this employer until XXXX, well after the account in question was opened in XXXX and charged off in XX/XX/XXXX. Because of this timeline, the original creditor could not have had this phone number on file. This directly contradicts the firms statement that the number was obtained from the creditors records. Additionally, this is a recorded business line, and call records exist confirming the inbound call from the firm on XX/XX/XXXX.

I am attempting to pay and resolve a credit card debt. The law office that reportedly holds the debt has not made the account available for payment despite my repeated attempts to resolve it. I have made the following documented attempts to communicate with this office : XX/XX/year> Sent an email requesting information on how to resolve the account. On the occasions when I was able to speak with a representative, I was repeatedly told that the account was being processed or on hold, and that I should call back later that day or in a few days when the account would supposedly be available for payment.

I called them around XX/XX/XXXX asking for a hardship due to my judgement proof status. They said we don't do hardships and we will continue trying to collect even if you are judgement proof. I sent a second round of judgement proof letters to both XXXX and XXXX XXXX of XXXX and got no reply. I began to get advertisements from bankruptcy lawyers saying I was being sued in XXXX of XXXX. Went online and XXXX being sued by XXXX and numerous other creditors that all know XXXX judgement proof.

Despite multiple emails and calls, I never received any confirmation or acknowledgment from the company. Because they failed to provide the required documents back to me in a timely manner, I had to pay out of pocket for several sameday deliveries to ensure I remained compliant. None of these efforts were ever confirmed by the company. Throughout XXXX, I made all required payments online as instructed, but again, I received no confirmation of any payments. I authorized recurring payments and ensured sufficient funds were available. I made multiple good-faith attempts to pay, but the firm failed to withdraw any payments. Because the firm did not process the authorized payments, they added interest and/or fees to my balance. These charges are inaccurate and were caused solely by the firms failure to process payments, not by any refusal or inability on my part to pay. XXXX XXXX served me with a summons and threatened to place a lien on my home. This caused extreme fear and distress. My home is my familys only place of residence, and the threat of losing it left me terrified of homelessness and unable to sleep or think clearly. Under that pressure, I felt I had no reasonable alternative. I agreed to a payment plan of {$300.00} per month for three years solely to prevent my family from being displaced. This agreement was not entered into freely or voluntarily, but under significant emotional and financial duress. I did not agree because I believed the debt was accurate, affordable, or fairly stated. I agreed because I feared the immediate and catastrophic consequences being threatened. I believe the tactics used deprived me of meaningful choice and resulted in an agreement obtained through coercion rather than informed consent.

They stated they sent a letter prior, which was never received by me. On XX/XX/2025, Lloyd & McDaniel , PLC filed a lawsuit against me in XXXX XXXX, Florida, without ever serving me notice of the lawsuit. I discovered the suit only because I received unsolicited advertisements from attorneys, not because the Plaintiff or their law firm complied with Florida service requirements. This legal action was taken while my account was in an active CFPB dispute, an XXXX state regulatory complaint, and after XXXX XXXX issued a written cease-and-desist letter dated XX/XX/2025. XXXX XXXX letter explicitly states that the account was placed with XXXX XXXX XXXX from XXXX XXXX XXXX 2025, then placed with Lloyd & McDaniel, and that XXXX XXXXXXXX is no longer servicing this account. This contradicts the representation now being made in court that XXXX XXXX is the rightful Plaintiff with standing. Lloyd & McDaniel also conducted unlawful collection activity in Florida prior to litigation while using an invalid business entity ( XXXX instead of XXXX ).
