I filed bankruptcy in XXXX. XXXX XXXX was included and any debts I owed to them was discharged. In XXXX of XXXX XXXX XXXX said there was an account opened without them and a loan taken out. After filing bankruptcy you can not receive a payday loan from XXXX XXXX. Im certain I never received a payday loan from them after filing bankruptcy. The damages claimed by XXXX XXXX are false and inaccurate. The items listed in the move-out charges do not reflect actual tenant-caused damage. I have email records showing XXXX XXXX was aware of ongoing issues and conditions within the unit during my tenancy. The charges submitted to XXXX include carpet replacement, wall patching and painting, tub repairs, tile repairs, and blinds. These charges either relate to ordinary wear and tear, pre-existing conditions, or maintenance issues known to management. For example, the carpet only showed normal wear from lawful occupancy, there were no pets in the unit, and there was no unusual damage that would justify full replacement. This debt collector has done unjustifiable practices of the FDCPA which it prohibits. They furnished this account that we didn't agree upon and I didn't sign an agreement on. A legal contract is signed by two parties and I did not participate in any of it. They didn't follow the proper 5-step validation procedure.
