In XX/XX/year> I fell behind, I was due XXXX, XXXX and then XXXX, I was set to make a payment and I called then to do so, when I called they asked why I fell behind, I explained and they stated I was eligible for a deferment for the past due, We discussed this, they sent me the approval, they actually sent it twice. I called back and we discussed the escrow shortage being paid over XXXX months, they put in a ticket to have someone explain the increase in the payment, which they did, so I took the deferral. I use the payment I had to pay credit card debt, I am very much so in debt and its a struggle I am treading water on. I received a letter on XX/XX/XXXX saying I was not eligible for assistance, I call, it said nothing about the deferment, but I was curious, they told me I was in an approved deferment, that letter just was saying I wasn't eligible for any other assistance plans.

During my interaction with the companys representative, I explicitly referenced this promotion and asked about it directly. I also clearly explained that I had received a significantly lower rate offer ( approximately 4 % ) from another lender and asked if they could match or beat it. The representative acknowledged my inquiry and responded by asking me to send the competing offer so they could review it and see what they could do. This new payment is higher then my mortgage payment that caused me to apply for the XXXX program. My situation is worse then it was before my XXXX loan modification. I will be pushed into foreclosure. XX/XX/year>, I requested an explanation as to why this was happening on the Onity secure messenger. I did not receive a reply. On XX/XX/year> I emailed XXXX at Onity a Relationship Manager for an explanation. XX/XX/year> I received Onitys response letter dated XX/XX/year>, stating the increase is entirely caused by a new XXXX escrow-shortage repayment plan. Onity did an escrow analysis on XX/XX/year> and determined my escrow account had a shortage of {$6600.00}.

My account was current at the time. The form states processing takes XXXX days, but Onity never acknowledged or processed it. I called on XX/XX/XXXX and was told the form was received and to allow another 10 days. I emailed again with no response. Because Onity had not set up the ACH, I paid {$400.00} on XX/XX/XXXX toward the XXXX payment. On XX/XX/XXXX, I called again and was told : the form was received on XX/XX/XXXX and was on file the remaining XXXX payment would be drafted between XX/XX/XXXX no late fee would be charged No draft occurred, and a late fee was added. During this call, the representative repeatedly insisted that I had requested biweekly payments, even though my written form clearly selected twicemonthly payments with specific dates.

PHH is currently being sued for doing exactly this. PHH changed their name to Onity, ( most likely because of this lawsuit ). I have been unemployed for almost XXXX years, the pharmaceutical company I was with lost their patent and laid off all its sales force. I was sending out resumes over XXXX resumes a month, getting to panel interviews only to be ghosted at the end. The job market in the XXXX XXXX has been extremely difficult until recently. When I did the loan modification everything was fine but then the payment after the loan modification jumped up {$800.00} due to insurance and property taxes increasing. My in-laws moved in and we were supporting them and keeping their mortgage going at the same time while my father-in-law was on XXXX until he past this XX/XX/XXXX. We listed the home to keep from going into foreclosure XX/XX/XXXX at the lowest amount they stated they would take {$700000.00} for a short sale ( 88 % ) of the amount owed ( {$780000.00} ). At this time my loan was with PHH. Fast forward to XXXX we started fire saling the home to get a contract to stay the foreclosure date and get it sold for as much as possible. PHH sold my mortgage to Onity in XXXX and on XXXX the short sale negotiator I was working with had to resend all the documents to the new company Onity.

They wanted a surplus in the account to avoid a shortfall even though there hasnt been a shortfall issue previously. I explained that there was never a lapse as they were the ones paying for the insurance out of the escrow account. How could there be a lapse if there was money in escrow and they paid directly to insurer and insurer was paid throughXXXX On XX/XX/26 my escrow account was slated to close and was told there is only {$38.00} in the escrow account. They still havent canceled the false insurance added nor reapplied the funds back ti my escrow account. Im of the belief that once you ask to start the process of canceling escrow they place false charges on an account essentially stealing from their client.

When I contacted the servicer they stated that I did not sign a document only to find out they did not send the document. They also confirmed that it was their error on multiple occasions but they still l was holding me responsible and I needed to reapply. During the first modification my ex-husband name was removed and all documentation for this to be completed was confirmed to be received. I reapplied and was approved once again. They sent the paperwork including my ex-husband 's name.

In XX/XX/year> PHH/Onity Mortgage sent a notary to my home the approved Loss Mitigation Notice was filled out and notarized and was told that my wife 's name didn't look like her name and it was rejected. Later in XX/XX/year> PHH/Onity Mortgage sent another notary to my home and the approved Loss Mitigation Notice was notarized and was rejected again because the notary used a USA Passport for identification and it was rejected. The actions of my mortgage company PHH/Onity Mortgage seems to setting me up for failure and foreclosure.

I am submitting this complaint regarding the servicing and administration of my FHA mortgage loan by PHH Mortgage/Onity Mortgage and the handling of my Trial Payment Plan during a financial hardship caused by Hurricane Milton . In XXXX, Hurricane Milton severely impacted my business and financial stability. From the very beginning, I communicated with my mortgage servicer in good faith to seek assistance and avoid foreclosure on my home. After multiple denials, I was eventually approved for a Trial Payment Plan for XXXX, XXXX, and XX/XX/XXXX. The XXXX payment was successfully processed from my XXXX XXXX XXXX account on XX/XX/XXXX, and I possess bank statements confirming that the funds were properly withdrawn from my account. However, when I later attempted to make the XXXX payment, I was informed that my Trial Payment Plan had been cancelled because the XXXX payment had allegedly never been received.
