For over a year, I have consistently used the same checking account to make my monthly payments without any issues. This is a long-standing bank account that I have maintained since I was XXXX XXXX XXXX, and there have been no changes to the account information. Within the past month or so, I have been unable to successfully make payments using this same account. My most recent payment was returned, and I was informed that XXXX XXXX system could not locate my account. This explanation is unacceptable, as the exact same account information has been used successfully for all prior payments. This issue appears to be the result of a system or processing error on XXXX XXXX end, not due to any fault of my own.

Referencing complaint # XXXX. XXXX bank sent me a letter stating that the vehicle was declared a total loss on XX/XX/XXXX and on that date the principal balance on account was {$31000.00}, and that the total loss settlement amount was received XX/XX/XXXX and for {$32000.00} and posted to account with an effective date of XX/XX/XXXX. the bank also states that the application of the total loss insurance payment brought the principal balance to {$140.00} which remained on account. the bank is stating that the total loss payment did not pay off the account. There is a CLEAR discrepancy in numbers due to the principal balance on account, as stated in writing by bank, being {$31000.00} at the time of vehicle being declared total loss, and the Settlement check being received for amount {$32000.00}. There is no clear reason for a balance to remain on account given the math of the XXXX amounts.

Prior to terminating my lease for a XXXX XXXX XXXX XXXX, I contacted XXXX XXXX to clarify my financial obligations. During that conversation, I was explicitly informed that if the vehicle sold for more than {$15000.00}, I would not be responsible for the remaining lease payments. Relying on this representation, I proceeded with lease termination. The vehicle was subsequently sold for more than {$15000.00}. Despite this, XXXX XXXX is now attempting to collect the remaining lease payments, directly contradicting the information I was provided. I went to two banks and nobody could help me. I want my money back.

I am filing this complaint because Santander XXXX has mishandled a clear case of fraud for nearly four months, repeatedly failed to investigate, closed my case twice without action, ignored multiple communications, and is now refusing to send a required hold harmless form to XXXX XXXX XXXX XXXX ( XXXX ), which is preventing the return of my stolen funds. On XX/XX/XXXX, XXXX day after opening a new savings account and submitting a car loan application online, a fraudulent {$4500.00} withdrawal was made from my Santander account. I did not discover the fraud until XX/XX/XXXX, when I received my monthly statement. I immediately reported it to Santander. Santanders Fraud Department closed the case two days later, without contacting me, without contacting XXXX XXXX XXXX XXXX, and without conducting any investigation.

I am submitting this complaint regarding Santander Banks handling of an unauthorized electronic banking transaction dispute totaling {$1000.00}. The disputed transaction occurred on or around XX/XX/XXXX. After discovering the unauthorized withdrawal, I promptly notified Santander and disputed the transaction, clearly stating that I did not authorize, initiate, consent to, or benefit from it. My physical card also remained in my possession throughout the relevant period. On XX/XX/XXXX, Santander issued a denial letter stating : Claim 001 is denied for inconsistencies. Customer states the card is still in their possession. This is card present CHIP/PIN transaction. Customer is not explaining how card would have been obtained. I am concerned Santander failed to conduct a reasonable investigation as required under the Electronic Fund Transfer Act and Regulation E ( 12 CFR Part 1005 ) and instead improperly shifted the burden onto me to explain the mechanics of the fraud itself.

I am filing a complaint regarding my auto loan account after my vehicle was declared a total loss following a car accident on XX/XX/year>. My insurance company ( XXXX ) issued an electronic payoff ( EFT/ACH ) to my lender ( Santander ) to satisfy the remaining balance on my auto loan for Progressive Claim XXXX. The payment was sent on XX/XX/year>, and the payment cleared on XX/XX/year>. Despite the lender receiving and clearing the payoff funds, my auto loan account still does not reflect as paid in full or closed. The lender continues to show the account as active. Timeline : XX/XX/year> : Vehicle involved in accident and later declared a total loss. XX/XX/year> : Insurance company issued EFT payoff to lender. XX/XX/year> : Payoff payment cleared. FACTUAL BACKGROUND : I am a Santander XXXX USA lease customer for a XXXX XXXX XXXX XXXX. My account was in good standing prior to this matter. I attempted to set up automatic payments ( autopay ) on a recorded call with Santander XXXX USA and believed autopay was active based on confirmation from the representative on that call. Approximately 68 months passed during which Santander did not debit my account for monthly lease payments. I did not receive any voicemails, letters, or other communications from Santander during this period that reached me. I still have not to this day, I have only called them. I had no knowledge that the autopay enrollment had not been processed or that my account was in default.

They informed me that the vehicle was still showing there was a lien on it and that I needed to contact XXXX XXXX ( original lending company ) and XXXX XXXX ( final lender ). I was able to find the lein satisfied statement that comes with the title I have in my possession, as well as a document from XXXX XXXX that is the " bill of sale '' that signs off the rights to the vehicle and the title. I took all of this to Secretary of State and was turned away because the title I have does not have any final odometer reading listed.

They try to keep money from customers. Some of us are elderly and live on a fixed income. Important : I did this once before, same company, and waited 2 months and had to borrow from family! The account in question was reportedly opened in XXXX and closed in XXXX, paid in full. Despite the age of the account and repeated disputes submitted to the furnisher and consumer reporting agencies, Santander continues furnishing damaging derogatory information without proper validation or lawful verification. Santander Consumer USA has failed to comply with its obligations under : 15 U.S.C. 1681s-2 ( b ) ( FCRA Section 623 ) ; 15 U.S.C. 1681e ( b ) ; 15 U.S.C. 1681i ; 15 U.S.C. 1681n and 1681o ( Sections 616617 ). Over a month ago, I requested a corrected bill of sale that includes XXXX XXXX Connecticut tax registration number/ID, which is required for my XXXX DMV lease buyout and title transfer process. Despite multiple calls and follow-ups, the requested document has still not been provided. In addition, I have now been informed that I also need a release of license plate/registration authorization document because it was not initially included with the paperwork sent to me. This missing documentation has delayed my ability to properly complete the DMV process and transfer ownership of the vehicle, and I have spent many unnecessary hours calling XXXX. I have repeatedly contacted customer service and have had significant difficulty obtaining accurate information, proper escalation, or resolution.

I later learned that this XXXX warranty was never activated and has never provided coverage ; when the car broke down soon after purchase with a leaking radiator, the manager refused to process a warranty claim, sent me {$1500.00} by XXXX for parts, and told me to go claim the car a lemon instead.

I believe the reporting is inaccurate, misleading, and damaging to my credit profile for the following reasons : Santander is reporting the account as charged off while continuing to report a past-due balance and collection status in a way that appears inconsistent and misleading. I have concerns that the balance being reported may not properly reflect credits, payments, fees, repossession accounting, or the fair market/auction value of the vehicle. Santander is the servicer of the loan on behalf of XXXX XXXXXXXX XXXX In response to my original CFPB complaint, Santander stated in writing on XX/XX/year> that the vehicle title was mailed to the Indiana Department XXXX XXXX at XXXX XXXX XXXX XXXX, IN XXXX on XX/XX/year> via first class mail. Based on XXXX response, the CFPB closed the complaint. However, as of XX/XX/year>, the Indiana Department of Revenue has confirmed they have no record of receiving the title from Santander. These transactions were occurring multiple times per day, sometimes two to three times in a single day, which is inconsistent with my normal banking activity and highly suspicious. I did not authorize or confirm those ATM withdrawals. Any possible response to a fraud alert was not related to the cash withdrawals.
