As of XX/XX/XXXX my account still shows I am 3 months behind on mortgage payments which is incorrect. I've sent a Notice of Error letter via certified mail which they received XX/XX/year>. They only have until XX/XX/XXXX to correct my account or my attorney will take legal action. They do not have 60 days to resolve this issue. I don't think they understand this.

Servicemac misapplied my XX/XX/XXXX mortgage payment in the amount of {$1400.00}. They continue to send statements that I am behind one month. I sent them in XX/XX/XXXX a list of payments from my bank account between XX/XX/XXXX and XX/XX/XXXX that shows I am not behind.

The loan assumption process for my home purchase began in XX/XX/XXXX. A buyer put an offer in on XX/XX/XXXX with the condition for a loan assumption of the current FHA loan. Currently the loan is through XXXX XXXX XXXX and serviced by Service Mac. The loan assumption is processed by Service Mac. The requisite files were submitted for initial review to Service Mac by buyer and seller in XXXX. The file did not make it to Underwriting review until XXXX of XXXX. The file further did not make it through initial underwriting review until XXXX of XXXX. Many complaints have been made to Service Mac regarding the process and I have had to make two mortgage payments while waiting for this process to end and close. Service Mac has been very delayed in any updates and keeping me informed in the process. We are now 6 months into a process that usually only takes 120 days max and we are still waiting underwriting to finish.…

I am a mortgage holder with ServiceMac. I am filing this complaint due to ServiceMaxs failure to maintain industry-standard security protocols for Personally Identifiable Information ( PII ) and their refusal to provide me with access to my monthly billing statements. ServiceMac has recently implemented a new web portal that requires users to enter their full, unencrypted Social Security Number and loan number. This data is transmitted without any evident hashing or encryption, creating a massive vulnerability for identity theft. Despite my repeated warnings to the company over the past month, no remediation has occurred. Furthermore, the company has refused to provide their XXXX XXXX or XXXX XXXX audit reports, which are necessary to verify their claims of a " secure '' environment. Because I can not safely use the portal, I am unable to view my monthly statements.…
Back in XXXX, I purchased my home and had XXXX XXXX as my lender / loan servicer. All my payments to them were made as they were automatically drafting money from my bank for years to pay for my mortgage loan. Unbeknown to me, in XXXX of XXXX, the loan to my house was sold to Servicemac / XXXX. I understand that sales of loans are normal in the mortgage industry, but this was not a normal sale. I say it was not a normal sale because I was never notified of it. Not by XXXX, and not by Servicemac / XXXX. One day I just received a call from Servicemac / XXXX saying I was late on my payment, and I had no clue who they were. After they informed me of who they were, I paid them whatever they claim was owed, but the damage was done. My credit report had been damaged due to no fault of my own. It is my understanding that if a mortgage lender sells a loan to a different lender, I am supposed to be notified about the sale or transfer weeks in advance.…
We are trying to close the sale of our home, XXXX XXXX XXXX XXXX, XXXX, XXXX XXXX. The title company is ready to close, but ServiceMac claims a payoff statement was sent on XX/XX/year>, but the attorney 's office ( XXXX, XXXX XXXX XXXX XXXX ) claims it was never received. Because of this deadlock, the transaction is stalling. ServiceMac verbally told us that they provided a payoff statement on XX/XX/year>, but would not provide evidence when requested. The title company ( XXXX XXXX XXXX XXXX ) has attempted to assist with no success. The buyer is an active-duty military service member who is scheduled for imminent XXXX. If we do not receive the payoff numbers by XX/XX/year>, the buyer will back out, leaving a deploying service member and his family unhoused and forcing a preventable foreclosure. We want to successfully close this transaction and pay off the debt. We need your help because ServiceMac refuses to talk with us, and the attorney 's office is not doing anything.…
We requested to have our escrow account removed from our mortgage. It went up XXXX a month after a tax evulation for XXXX. We are fighting our taxes with our county and do not believe our taxes will be that much more this year. We wanted to handle taxes and insurance on our own moving forward. Our only stipulation to remove our escrow was to have a XXXX or positive balance. As of XX/XX/XXXX we had a postive {$100.00} balance to which we asked escrow to be removed. We recieved a letter dated XX/XX/XXXX from ServiceMac that our escrow was approved to be removed and would offically be off of our account on XX/XX/XXXX. On XX/XX/XXXX ServiceMac paid our insurance company XXXX putting us back in negative balance and claiming we could no longer remove our escrow until this was paid. Our insurance payment wasnt due until XX/XX/XXXX. After numerous phone calls and emails they refuse to stop payment on their check offering no solutions for their internal mistake.…
I am an FHA borrower roughly XXXX months behind on my mortgage due to a job loss in XX/XX/XXXX. My loan is serviced by ServiceMac , LLC ( subservicer for XXXX XXXX XXXX ). I submitted a loss mitigation application on XX/XX/XXXX, which the servicer marked " XXXX. '' In early XX/XX/XXXX I called and requested a forbearance, which was placed on my loan effective XX/XX/XXXX. As the forbearance ended, I called again in XX/XX/XXXX to discuss next steps and expected to receive trial plan terms in writing, per standard FHA procedure. On XX/XX/XXXX, the servicer denied my loss mitigation application, citing that my loan " has exceeded the limit for defaulted trial plans. '' I appealed. On appeal, the servicer stated that a trial plan was issued in XX/XX/XXXX and that I failed to make the trial payment. This is the core problem : no trial plan was ever delivered to me through any channel. I was never given a trial payment amount or due date.…
My mortgage servicer failed to make scheduled property tax disbursements from my escrow account in XX/XX/XXXX and XX/XX/XXXX, causing my XXXX XXXX property taxes to fall delinquent. In XX/XX/XXXX, the servicer performed an escrow analysis and calculated a surplus of {$10000.00} a figure that was inflated solely because the unpaid taxes had not yet left the account and refunded that amount to me. In XX/XX/XXXX, the servicer made a lump-sum payment of {$15000.00} to cover the delinquent taxes. The servicer acknowledged the error in writing on XX/XX/XXXX, stating : " The tax team failed to add the correct tax information causing the taxes to not be reported and to fall delinquent. '' Following the lump-sum disbursement, the servicer issued an escrow shortage notice of {$9500.00} and increased my monthly mortgage payment by {$790.00} beginning XX/XX/XXXX to recover that shortage despite the shortage being a direct result of their own mismanagement.…
I purchased my home in XXXX from XXXX XXXX XXXX, and I am a first-time homeowner. Recently, I received a letter from the XXXX XXXX XXXX XXXX advising that I am behind approximately {$10000.00} in escrow payments. After looking into the matter, I was informed that my property taxes were not properly assessed on the improved property value of the home, but instead were only assessed based on the lot itself. As a first-time homeowner, I relied on my mortgage company and escrow process to properly calculate and collect the correct amount for property taxes. I was never made aware that the escrow amount being collected was insufficient due to the property not being fully assessed. This situation has now created a significant and unexpected financial burden on my family. I am requesting that this matter be reviewed to determine whether there was any oversight, negligence, or failure to properly disclose or calculate the escrow obligations associated with my property taxes.…
I went under contract on a property with an assumable VA loan on XX/XX/year>. On XX/XX/XXXX, call attempts and an email were made to the mortgage department of ServiceMac, the lender to begin the assumption request. The lender did not cooperate until XX/XX/XXXX when the lender agreed to mail the assumption packet. The packet was received and digitized by the seller 's agent on XX/XX/XXXX. The buyer completed and returned the assumption packet to the lender on XX/XX/XXXX. The lender reviewed the packet and requested additional information which was acknowledged as received in entirety by the lender on XX/XX/XXXX. Since XX/XX/XXXX, the lender has slowly requested petty additional information from the buyers over the course of several weeks. When queried about the status, the lender has simply stated the application is in a queue. On XX/XX/XXXX, XXXX XXXX XXXX took over processing of the loan.…
I am submitting this complaint regarding my mortgage servicers handling of my loan modification documents and what appears to be an unfair and inconsistent signing deadline. I was informed in written communication through an email that I would have 7 days to review and sign my loan modification documents. The loan modification documents were made available to me through an online notary platform on XX/XX/year>. However, the documents were set to expire on XX/XX/year>, giving me only 2 days to complete signing instead of the 7 days I was told I would have. When I raised this issue with the servicer in writing, they responded that no error occurred but did not address the discrepancy between the 7-day timeframe communicated to me and the 2-day expiration actually imposed. Instead, I was directed to call their Loss Mitigation Department, and the issue remains unresolved.…
I am filing a complaint regarding the mishandling of my mortgage payoff, escrow refund, and unauthorized retention of funds by ServiceMac following the refinance and transfer of my mortgage to XXXX XXXX XXXX. My mortgage with ServiceMac was officially paid off on XX/XX/year> as part of my refinance to XXXX. However, despite the payoff, ServiceMac still processed my scheduled automatic mortgage payment on XX/XX/year>. This payment should have either been stopped, reversed, or properly accounted for following the payoff, but to date I have not received any explanation or refund regarding these funds. Additionally, I have not received my escrow balance refund. When I contacted ServiceMac, I was verbally informed that my escrow balance was approximately {$3000.00}, but I was also told that approximately {$1000.00} was being deducted for reasons their representatives could not clearly explain or document.…
My payoff quote dated XX/XX/year> automatically netted the escrow balance of {$4000.00}, but I did NOT request or authorize my escrow to be applied to reduce the payoff. I signed a FHA Escrow refund document advising that the surplus be refunded to me, not used to lower the payoff amount. On XX/XX/year>, Servicemac completed a final escrow analysis showing a final surplus of {$2900.00}. This is the amount FHA requires to be refunded after payoff. Servicemac issued a refund check for {$2900.00}, and this refund is shown in my escrow ledger on XX/XX/XXXX as ESC REFUND XXXX. However, Servicemac later reversed the refund and claimed the payoff was short because the escrow had been netted. This explanation contradicts their own escrow ledger and shortyear statement.…
ServiceMac , LLC improperly placed lender-placed hazard insurance on my mortgage ( Loan # XXXX, property at XXXX XXXX XXXX XXXX XXXX TX XXXX ) despite my homeowner 's insurance being verified and on file. Timeline : On XX/XX/XXXX I received a XXXX confirmation that my insurance information was reviewed and updated. On XX/XX/XXXX, servicing transferred from XXXX XXXX XXXX XXXX ServiceMac. Despite my insurance being on file before the transfer, ServiceMac placed LPI effective XX/XX/XXXX at $ XXXX. On XX/XX/XXXX they sent a " second and final notice '' claiming no insurance was on file. In XX/XX/XXXX they disbursed {$3200.00} from my escrow for the LPI premium, driving my escrow to - {$3200.00}. Their XX/XX/XXXX escrow analysis shows a {$5800.00} shortage and projects another {$3200.00} LPI disbursement in XX/XX/XXXX. My monthly payment is being increased from {$4100.00} to {$4800.00} effective XX/XX/XXXX a $ XXXX increase entirely because of LPI that should never have been placed.…

I am submitting this complaint regarding an unresolved issue with an FHA Payment Supplement ( Partial Claim ) associated with my mortgage. Per written communication from the servicer dated XX/XX/XXXX, the total FHA Partial Claim was {$25000.00}, with the following breakdown : {$15000.00} applied to bring the loan current {$1100.00} applied toward payment reduction ( XX/XX/XXXX XX/XX/XXXX ) {$9100.00} identified as a remaining unused balance I sold the property on XX/XX/XXXX, and at closing, both the primary mortgage and the full FHA Partial Claim amount were paid in full from the sale proceeds. However, the servicer has not provided any accounting or explanation regarding the disposition of the {$9100.00} unused balance. My mortgage loan was transferred to ServiceMac LLC from my original lender. Shortly after the transfer, ServiceMac improperly placed a force-placed hazard insurance policy on my property despite the fact that I have maintained continuous homeowners insurance coverage. As a direct result of this error, my monthly mortgage payment increased from approximately {$5200.00} to {$9500.00}. I immediately provided proof of insurance multiple times and have spent over XXXX months attempting to resolve this issue through repeated phone calls. ServiceMac has acknowledged the issue partially and issued a partial refund. However, they still owe approximately {$11000.00} in overpaid funds. Additionally, they have failed to correct my escrow account, and I continue to be billed the incorrect inflated monthly payment and a incorrect escrow account. Despite my repeated efforts and submission of documentation, the issue remains unresolved.…

Servicemac LLC incorrectly reported a foreclosure on my credit report when they were paid in full.
Service Mac LLC, I paid off a loan and I was requesting a refund of my escrow account. According to the company they allow upto 20 days from close of escrow to get that money to you. My escrow closed the XX/XX/XXXX, and I gave them 20 days and no ck in the mail box. I called today, XX/XX/XXXX, looking to see when the ck when out maybe it was lost in the mail. Customer service said the ck was mailed out XX/XX/XXXX, and I should give it a few more days to get to me. She also put me on hold to ask escrow if they can wire it to me, escrow said no. Then customer sevice said give it another 4 days. This tells me they have not mailed it yet. I live in California and I have mailed across country many times and at most it takes 4 days. My point is it should not take 30days to get a refund. I believe this company has no intigrity.
They reported a foreclosure on my credit that didnt occur. They were paid in full.
On XX/XX/year> I went to pay my mortgage for XXXX and I noticed it went up about {$150.00}. I check my escrow analysis and I see that they increased the amount they are taking for my property taxes. This is understandable as in XXXX XXXX XXXX had valued my property without a house on it. There is now a house on it so I knew it would be increasing. On the escrow analysis the have an " estimate '' for what they will be taking out of my account for property taxes. They are saying {$1700.00} will be leaving my account this month XX/XX/year>. I am assuming that is to XXXX my property taxes that are due in XXXX. However, the county already has my bill available and I only owe {$79.00} for XXXX. Due to the mortgage companies gross overestimate they are saying I will have a shortage in my escrow account of $ XXXX and they will be collecting that over the next XXXX XXXX The other issue is their estimates for my property taxes.…
I am filing a complaint regarding a serious escrow mismanagement issue by my mortgage servicer Service Mac. My mortgage company paid property taxes from my escrow account using an incorrect parcel number, resulting in payment being applied to another property. As a result, my actual property taxes in XXXX XXXX, Texas remain unpaid and are now delinquent, with penalties and interest continuing to accrue. This issue has been under investigation for over three months, with no resolution. During this time : My tax account has become delinquent Additional fees and penalties are accumulating I have not received a clear resolution timeline or written confirmation of corrective action This situation is a direct result of my mortgage servicers error and failure to properly manage my escrow account. This payment was accepted and posted by the prior servicer. After the transfer, my loan is now being handled by ServiceMac ( I also received a conflicting transfer notice referencing XXXX XXXX ). I have been able to locate my loan in ServiceMacs system ; however, my account is incorrectly showing as past due for the XX/XX/year> payment. The XX/XX/year> payment was intended to satisfy the XX/XX/year> due date. This payment has not been properly transferred or applied to my account. SUBJECT : URGENT ESCALATION VA-Approved Short Sale | Servicer-Caused Delay | Request for Expedited Review under contract since XX/XX/XXXX. Still in Review Good afternoon, I am writing to formally escalate the above-referenced short sale file due to significant delays directly attributable to servicing issues. The U.S. Department of Veterans Affairs issued approval for this short sale on XX/XX/XXXX. However, as of XX/XX/XXXX, ServiceMac had not acknowledged receipt of that approval and issued a delay notice citing lack of response from the VA. At our request, the VA re-sent the approval, after which ServiceMac confirmed receipt. At that point, we were advised that all previously submitted documents had expired and were required to be updated and resubmitted. All requested updated documentation was promptly provided on XX/XX/XXXX. However, we have now been informed that the file will be subject to an additional full review period. This situation is unacceptable.…
My servicer is not following the rules for loss mitigation / dual tracking ServiceMac recorded a Notice of Trustees Sale on XX/XX/XXXX while my loss-mitigation application was already officially marked complete in their Loan Solution Center portal on XX/XX/XXXX at XXXX XXXX ET. The Notice of Default was recorded on XX/XX/XXXX, so the XXXXday period did not expire until XX/XX/XXXX. The XXXX was therefore recorded prematurely ( on Day XXXX of the XXXX period ) and while a complete application was pending. This is a material dual-tracking violation under California Homeowner Bill of Rights XXXX and XXXX and federal RESPA XXXX XXXX XXXX. Even though XXXX XXXX XXXX ( a ) ( XXXX ) contains a narrow XXXX safe-harbor provision for recording a NOTS slightly early, that safe harbor does not override the separate and stricter prohibition on recording a NOTS once a complete loss-mitigation application has been received.…
I am submitting a complaint regarding inaccurate mortgage servicing, payment misapplication, and inconsistent account reporting following a servicing transfer. My mortgage loan transferred from XXXXXXXX XXXX to ServiceMac , LLC effective XX/XX/year>. Prior to and during the transfer, I made my XXXX and XX/XX/year> mortgage payments to the prior servicer, XXXX XXXX. I have proof of these payments. However, after the transfer, ServiceMac failed to properly reflect these payments and appears to have misapplied subsequent payments. Specifically : - My XX/XX/year> payment was treated as unpaid despite being made to the prior servicer. - A later payment was applied to XX/XX/year>, indicating a failure to properly transfer or reconcile payment history. - My account was then placed in a delinquent status. I have also received conflicting information from ServiceMac : - In one communication, I was told my loan was only due for XX/XX/year> and that there was no imminent default.…
I closed on my mobile home on XX/XX/XXXX. The house was clear for a post-close de-title. I received a credit for prorated property taxes from the seller during closing. This was supposed to be put towards paying off my property taxes. It states in my closing documents that my property taxes and insurance are to be escrowed and 13 months of property taxes and insurance were collected at closing. I also signed in the closing documents that the purchased home address is my new mailing address. I also submitted a primary residence 4 % special assessment form which they accepted. The first year went by and on XX/XX/XXXX I received a neon letter on my house from the county saying the house will be sold at tax sale due to delinquent taxes with a deadline to pay the taxes. Mind you I have never missed a mortgage payment.…
