XXXX at XXXX confirmed that the payment cleared on XX/XX/XXXX Email received XX/XX/XXXX showing loan paid in full. They have XXXX business days to return your escrow fund XX/XX/XXXX would have been the date they needed to send payment by XX/XX/XXXX I called them on the phone to check on status and thye let me know it showed pending and they would put a rush on it. When I asked how long that may take they could not provide a lead time and let me know that due to XXXX of XXXX a lot of people were out of the office and they told me to follow up the next week to check status. As of XX/XX/XXXX still have not received check / refund

I paid off my mortgage loan on XX/XX/year>. After the payoff was completed, I expected to receive the remaining balance from my escrow account. As of XX/XX/year>, I still have not received the escrow refund check, nor has one been issued according to the account activity history. Concerned about the delay, I contacted the mortgage servicer twice within the last two weeks. During both calls, I was informed that the matter would be escalated and that the company was experiencing " back-end '' issues related to escrow refund payouts. I was also told to continue checking my account activity history to see when the check would be issued. Despite these assurances, no escrow refund has been issued and no resolution has been provided. I am filing this complaint because the escrow refund remains outstanding more than six weeks after the loan was paid in full, and the company has not provided a clear timeline for payment or an explanation for the continued delay.

The XXXX mailed the recast application to me which I completed and mailed back with XXXX ( XXXX ) checks ( the lump sum payment for {$60000.00} and the {$500.00} processing fee ) on XX/XX/year>. It is noted that, due to unclear instruction in the paperwork, I called the XXXX to confirm the process prior to sending in the checks. I followed the XXXX 's instructions exactly. The documentation indicated that, if received after the XXXX of the month, the revised monthly payment would be effective not the next month, but the following month.

I am seeking a deed-in-lieu of foreclosure through ServiceMac 's loss mitigation process. My application has repeatedly been denied or closed because ServiceMac states that I failed to provide documentation showing that my property was listed for short sale and that offers were received. This is incorrect. After speaking with a ServiceMac manager, I was specifically instructed to submit my listing agreement, short sale documents, and purchase offers because the liquidation team could no longer access them. I promptly submitted all of the requested documentation. Despite this, ServiceMac continues to state that the documentation was not received or is not reflected in my file, and my application is again being closed without a proper review for deed-in-lieu. I have made numerous calls attempting to resolve this issue, but I continue to receive the same response despite complying with every request.

Ive been paying {$2600.00} for almost 2 years. There was no notice or contact with me. I never spoke to anyone. They said there was nothing I could do except pay off the escrow. On XX/XX/2026 I applied {$15000.00} to my escrow account. To lower my payment. After XXXX weeks of it still showing my XXXX payment at {$5200.00}, I called again and they said it wasnt applied to escrow and they would do it and to check back with them. After another XXXX weeks it was still showing {$5200.00} so I called again on XX/XX/XXXX, they said it in fact was still not applied and they would do it now. Now theyre saying it will be updated with my new monthly payment by XX/XX/XXXX. I have an auto draft on my account for XX/XX/XXXX, so I called to ask them to change it to the XXXX after my monthly payment is updated.

I am filing this complaint against my mortgage servicer, Service Mac, for a severe violation of servicing duties regarding the managment of my homeowner 's insurance notifications and escrow processing. On XX/XX/XXXX, a fire took place on my property destroying our detached garage, shed, and everything inside of it. When we called XXXX to file a claim, they notified us that our homeowners policy was no longer valid and had been cancelled. We called our mortgage company, XXXX XXXX to see if any force placed coverage was in place. They were surprised to hear this as we were still showing as insured with XXXX and didn't have anything in place because of that. I called XXXX once more and demanded to see all correspondence with the mortageg company as they were claiming that they had been properly notified. Upon doing this, I had found out they had notified Service Mac and not our lender directly.

This was a clerical error with XXXX XXXX XXXX. They asked me to send proof that it was an error to which I did and uploaded to their system using the site uploadmytaxdocs.com password was XXXX. I called XXXX days later asking whether these were received which I was informed they were. I spoke with a XXXX who informed me and I also have an email there would be no late fees while this all gets resolved. However I have been hit with XXXX late fees over {$100.00} so far.

I am seeking a Deed in Lieu ( DIL ), but the servicer repeatedly forces me into a 'Short Sale ' process I never authorized, requiring inapplicable documentation ( e.g., Closing Disclosure ) and closing my application as 'incomplete ' when I can not provide these. During a previous DIL attempt, the servicer failed to disclose a vacancy requirement, causing the application to fail ; they now use this failure to justify denying my current DIL request. My account balance has improperly ballooned making it harder to sell my house and walk away with any anything, due to fee pyramiding ( including questionable inspection fees on an occupied home ) while I have been in good-faith loss mitigation. I have requested an itemized audit of these fees and documentation of the policy requiring a 'failed short sale ' for a DIL, but the servicer refuses to provide this or correct the file coding.

I received an escrow analysis statement from XXXX ServiceMac mortgage company dated XX/XX/year>, and noticed that my new monthly mortgage payment is scheduled to increase to {$5900.00} from {$4100.00}, effective XX/XX/year>. Upon review, this escrow analysis contains a gross calculation error, assessing a {$10000.00} charge for Private Mortgage Insurance ( PMI ). At the time of closing three years ago, no monthly PMI premium was established on the closing disclosures, nor was it ever billed by the originating lender, despite the down payment being less than 20 %. No active PMI policy was bound. A mortgage servicer can not retroactively bill a consumer for a prior administrative omission by the originating lender. Furthermore, because the property principal has been paid down consistently for 36 months, current home equity limits the legal application of future PMI under the Homeowners Protection Act.

The loan assumption process for my home purchase began in XX/XX/XXXX. A buyer put an offer in on XX/XX/XXXX with the condition for a loan assumption of the current FHA loan. Currently the loan is through XXXX XXXX XXXX and serviced by Service Mac. The loan assumption is processed by Service Mac. The requisite files were submitted for initial review to Service Mac by buyer and seller in XXXX. The file did not make it to Underwriting review until XXXX of XXXX. The file further did not make it through initial underwriting review until XXXX of XXXX. Many complaints have been made to Service Mac regarding the process and I have had to make two mortgage payments while waiting for this process to end and close. Service Mac has been very delayed in any updates and keeping me informed in the process. We are now 6 months into a process that usually only takes 120 days max and we are still waiting underwriting to finish.

We paid exactly what was quoted as the payoff amount, and this situation is unacceptable. Your representative indicated that the discrepancy is due to ServiceMac paying our homeowners insurance. However, we have never escrowed our insurance or taxes, and ServiceMac had no authorization or basis to pay our homeowners insurance on our behalf. The title company has already confirmed with our insurance provider that we paid our insurance directly and that it was current at the time of closing.

This data is transmitted without any evident hashing or encryption, creating a massive vulnerability for identity theft. One day I just received a call from Servicemac / XXXX saying I was late on my payment, and I had no clue who they were. After they informed me of who they were, I paid them whatever they claim was owed, but the damage was done. My credit report had been damaged due to no fault of my own. It is my understanding that if a mortgage lender sells a loan to a different lender, I am supposed to be notified about the sale or transfer weeks in advance.

In addition, ServiceMac appears to have paid not only our XXXX property taxes, but also property taxes for periods before we even owned the property. Separately, I was advised by a ServiceMac customer advocate that I could reduce my monthly mortgage payment by obtaining my own homeowners insurance policy. '' In early XX/XX/XXXX I called and requested a forbearance, which was placed on my loan effective XX/XX/XXXX. As the forbearance ended, I called again in XX/XX/XXXX to discuss next steps and expected to receive trial plan terms in writing, per standard FHA procedure. On XX/XX/XXXX, the servicer denied my loss mitigation application, citing that my loan " has exceeded the limit for defaulted trial plans. '' I appealed. On appeal, the servicer stated that a trial plan was issued in XX/XX/XXXX and that I failed to make the trial payment. This is the core problem : no trial plan was ever delivered to me through any channel. I was never given a trial payment amount or due date.

The lender did not cooperate until XX/XX/XXXX when the lender agreed to mail the assumption packet. The packet was received and digitized by the seller 's agent on XX/XX/XXXX. The buyer completed and returned the assumption packet to the lender on XX/XX/XXXX. The lender reviewed the packet and requested additional information which was acknowledged as received in entirety by the lender on XX/XX/XXXX. Since XX/XX/XXXX, the lender has slowly requested petty additional information from the buyers over the course of several weeks. When queried about the status, the lender has simply stated the application is in a queue. On XX/XX/XXXX, XXXX XXXX XXXX took over processing of the loan.

I am submitting this complaint regarding my mortgage servicers handling of my loan modification documents and what appears to be an unfair and inconsistent signing deadline. I was informed in written communication through an email that I would have 7 days to review and sign my loan modification documents. The loan modification documents were made available to me through an online notary platform on XX/XX/year>. However, the documents were set to expire on XX/XX/year>, giving me only 2 days to complete signing instead of the 7 days I was told I would have. When I raised this issue with the servicer in writing, they responded that no error occurred but did not address the discrepancy between the 7-day timeframe communicated to me and the 2-day expiration actually imposed. Instead, I was directed to call their Loss Mitigation Department, and the issue remains unresolved.

I am filing a complaint regarding the mishandling of my mortgage payoff, escrow refund, and unauthorized retention of funds by ServiceMac following the refinance and transfer of my mortgage to XXXX XXXX XXXX. My mortgage with ServiceMac was officially paid off on XX/XX/year> as part of my refinance to XXXX. However, despite the payoff, ServiceMac still processed my scheduled automatic mortgage payment on XX/XX/year>. This payment should have either been stopped, reversed, or properly accounted for following the payoff, but to date I have not received any explanation or refund regarding these funds. Additionally, I have not received my escrow balance refund. When I contacted ServiceMac, I was verbally informed that my escrow balance was approximately {$3000.00}, but I was also told that approximately {$1000.00} was being deducted for reasons their representatives could not clearly explain or document.
