The previous collector, XXXX XXXX XXXX, XXXX, failed to validate this debt despite receiving XXXX formal certified demands for validation. In XX/XX/XXXX, I started receiving collection related mail from Zwicker PC about collecting debt in behalf of XXXX XXXX. On XXXX, I called Zwicker PC and spoke with an associate disputing the collections. I relayed that I have reported to XXXX XXXX multiple times in XXXX about the fraudulent activities regarding my accounts ( 2 credit cards and 1 debit/checking account ). I emailed the related police reports and IC3 reports to XXXX per their instruction. I continue to receive mail that I still owe debt to XXXX XXXX. I called back to Zwicker PC on XXXX to request for the research documents used to deny my claim of fraud. I was not provided the information used, other than a phone number to a card member liaison.
I have instructed Zwicker & Associates, XXXX. to stop emailing or calling me, and to direct contacts to my attorney. I have emailed them twice now but they continue to call and email me.
Contacted Zwicker and Associates to settle an outstanding debt collection that had a judgement. We agreed on a payoff amount over the phone but they refused to send any type of agreement in writing. I do not even have an accurate payoff amount for the full judgement and the claim was because the interest rate charged changes daily to the amount owed. I asked if I paid the agreed amount over the phone in that moment would I receive a receipt stating paid in full and they said no I would have to contact another number with the attorney who was assigned to that claim. I called the number provided to speak directly to the attorney and it just called the same automated number. As of now they claim they can not give anything in writing and XXXX person stated that the phone call was recorded and that was enough!

I am submitting an additional complaint regarding Zwicker & Associates and their handling of XXXX alleged XXXX XXXX accounts. On XX/XX/year>, I mailed a certified debt validation request directly to Zwicker. Zwicker has acknowledged receiving this correspondence. Despite this, Zwicker has stated in prior CFPB responses that they did not communicate directly with me and instead directed all communications, including alleged validation, to a third party, XXXX XXXX, which they referred to as my agent or representative. I have been attempting to make payments toward a Consent Judgment Agreement handled by Zwicker & Associates on behalf of a major credit card issuer. The agreement requires monthly payments, and I have been making them as scheduled. Recently, the online payment portal stopped accepting my File ID and displayed an error stating that the file ID is invalid or that the account can not access the portal. I contacted the firm multiple times by phone and left several messages requesting assistance, but I have not received any response. Because the portal is inaccessible and the firm has not returned my calls, I can not verify my payment status, confirm that my payments are being properly credited, or obtain updated balance information. I have requested a settlement agreement from Zwicker and Associates and a statment of account, how they are applying my monthly payments to the two separate loans but I have not received either. In fact, XXXX XXXX a XXXX at Zwicker has barred my accounts claiming they were blocked by XXXX XXXX XXXX the owner of the debt but they tell me that they haven't done such a thing and that the collection agency is directed to settle the debt with a financially feasible payment plan. Zwicker & Associates has done nothing but treat me poorly and lie about my complaints. They said that their firm did not prevent me from making payments on my account. I called 3 times to make a payment and did they accept it???? NO! Then YES, their firm did prevent me from making payments on my account. They are trying to break me down with repeated violations of the law. That is what Zwicker & Associates does. They are aggressive, rude and unprofessional. I called Zwicker & Associates shortly after XXXX XXXX to make a {$750.00} payment to cover XXXX & XXXX. I made the payment and specifically asked XXXX XXXX to make sure that Zwicker did not try to take money out of my checking account since I had just made a double payment. He said they would not. Then on XX/XX/XXXX they tried, unsuccessfully, to draft my checking account for {$370.00} after I specifically asked them not to. This resulted in overdraft fees that I had to pay due to their mistake. When I first entered into my payment agreement with them I was told I would make XXXX payments of {$370.00} to settle the debt. When I call them to discuss my account they tell me that I owe them {$12000.00}. That is far more than the payment arrangement that we initially agreed to. They are trying to get me to pay more money that our agreed upon settlement. That is not fair to me and is dishonest.
Zwicker & Associates is forcing me to pay more than I can afford every month. I asked if I could pay less and they said no, and if I did not pay the amount they demanded in the time frame they demanded that they would take me to court. XXXX XXXX, an agent for Zwicker & Associates calls me constantly demanding money. He is polite when he calls at first. He says that he is on a recorded line. After we speak he calls me back from a different number and threatens me with financial ruin if I do not pay him. He called me a loser and said that its my fault that Im in this situation. Then he said that I probably come from an entire family of losers.
